There is concern in the agriculture industry that if a higher court was to agree with the Washington court ruling that manure from dairies could be deemed solid waste, dairies and other livestock operations across the country could face manure management restrictions that would be unmanageable. Agriculture interest groups are closely following a case in Washington state where a federal court recently ruled manure could be deemed a solid waste. Plaintiffs in the case say the ruling sets a precedent.
