Low-Carbon Fuel Standard Takes Hit

OMAHA (DTN) -- The state of California will need to reconsider its low-carbon fuel standard and its effect on the U.S. ethanol industry after a federal appeals court ruling Monday.

The court ruled, among other things, that the California Air Resources Board did not consider information and didn't adequately hold a public hearing on a number of controversial issues including the carbon intensity values attributed to ethanol based on the theory of indirect land use change.

Indirect land use change theory says expanding U.S. corn acres to supply ethanol production is leading to land use change in other countries.
