Congress Clarifies OSHA Rule

SAN ANTONIO (DTN) -- Congress added language to an omnibus appropriations bill expected to pass this week that reaffirms to the Occupational Safety and Health Administration that the agency doesn't have authority to expand its regulatory reach to small farms.

OSHA inspectors began inspecting grain bins at farms in 2011 after a memo advised inspectors to begin looking at the safety of grain bins.

Sen. Mike Johanns, R-Neb., pushed for the language to clarify the three-decades-old ban that prevents OSHA from regulating farms with fewer than 10 employees. This became a major issue for Johanns last month after learning that ...
