Ag Groups Eye NPDES Case

OMAHA (DTN) -- A case pending before a federal appeals court could affect thousands of farmers and others who have general National Pollutant Discharge Elimination System (NPDES) permits by possibly requiring them to get costlier, harder-to-obtain individual permits for discharges into waters of the U.S.

A U.S. district court in Kentucky recently issued a ruling that keeps in place a legal shield to protect farmers, ranchers and others who hold NPDES permits, from lawsuits and Clean Water Act violations.

It is the appeal in the Sixth Circuit Court of Appeals that has two agricultural groups concerned.
